Jammu and Kashmir - Issues and Dimensions
One-day Seminar organized by VIGIL - Public Opinion Forum, Chennai, India

On Jan.27, 2001 (Saturday), 9am - 6pm
at Bharatiya Vidya Bhavan (Mini Hall),
Mylapore, Chennai - India

VIGIL has arranged this one-day Seminar to crystallize comprehensive information about the Jammu and Kashmir imbroglio.

Eminent scholars from different walks of life - social workers, journalists, academicians, lawyers, diplomats etc. - have been invited to make presentations in a full-day brainstorming Seminar.

The speakers are:

  1. Shri P.Parameswaran (Vivekananda Kendra),

  2. Dr. Swapan Dasgupta (India Today),

  3. Professor Pranawa C. Deshmukh (IIT, Chennai),

  4. Shri B.Raman (Retd. Addl. Secy., Cabinet Secretariat) and

  5. Ms. Nancy Kaul (Panun Kashmir).

The members who will lead the panel discussion are:

  1. Shri C.V.Narasimhan (Former Director, CBI),

  2. Shri B.S.Raghavan (Policy Advisor to UN),

  3. Professor V.Suryanarayan (Retd. Director, Center for South Asian Studies),

  4. Professor M.D.Srinivas (Sr.Fellow, Center for Policy Studies),

  5. Professor Gopalji Malviya (Madras University) and

  6. Shri G.R.Swaminathan (Advocate).

The VIGIL seminar aims at highlighting and demonstrating a number of irrefutable facts:

  1. The absolute legality and constitutionality of Jammu and Kashmir’s accession to India under the Indian Independence Act, 1947, of the British Parliament.

  2. The UN resolutions called for Pakistan’s withdrawal of its tribals, unlawful nationals and armed forces from J&K as a PRE-CONDITION to plebiscite.

  3. Pakistan did not comply with the relevant parts of the UN resolutions. Even as Pakistan went on demanding a plebiscite, it was afraid to face it and in fact rejected it. This led to UN declaration in 1964 that the issue must be resolved bilaterally alone with no outside interference.

  4. The Constitution of the State of Jammu and Kashmir already expresses a LEGAL and DEMOCRATIC statement of the WILL OF THE PEOPLE which decided irrevocably that "JAMMU and KASHMIR IS AND SHALL BE AN INTEGRAL PART OF INDIA".

  5. Pakistan’s claim that it protects the interests of Muslims is hollow.

  6. Article 370 of the Constitution of India has been and is a hurdle in the development of the J&K State. On behalf of the People of India, the Parliament of India resolved on February 22, 1994 that:

  7. This Seminar reiterates the resolve expressed in the above Parliamentary resolution and alerts that the people of India expect it to be fulfilled in letter and spirit.

  8. We demand that the basic hurdle, namely Article 370 of the Indian Constitution, which prevents human and material investment in the State of J&K and thus disables the development of the State be abrogated.

  9. We alert the policy makers that the people of India will reject any quick-fix solution that does not recognize the legality, invincibility, completeness and irrevocability of J&K’s accession to India.

  10. The State of J&K is a national heritage and the people of India stand committed to ensure the right to security, peace and prosperity of all their brethren in the State - Buddhists, Christians, Hindus, Muslims, Sikhs etc.

  11. We urge that effective information dissemination take place in J&K as in the rest-of-India pertaining to the completeness and irrevocability of J&K’s integral status in the Union of India.

  12. As an integral part of the solution, we demand the rehabilation of the displaced Kashmiri Hindus and demographic rationalization of the State.

  13. This seminar voices the aspirations of the people of India that Kashmiris be made equal partners in India’s march into its brilliant future.
